Requesting for a case to be set aside

You may be able to cancel a CCJ if you meet specific criteria. To do this, you will need to complete an N244 form which is available online. There is a time frame, so filling out and submitting the form should be completed as quickly as possible. There are a few options if there’s a real chance that your creditor may re-apply for another CCJ. You can either work towards implementing a viable repayment scheme or begin preparation for your defence, whichever is most appropriate.

Setting aside a CCJ, however, is usually only applicable if  you were not aware of the CCJ. (for example, creditors sent the claim form to an old address), or you have a genuine argument against the CCJ. (for instance, you have already paid off the debt).

There is a charge to set aside a CCJ in court. If you are on a low income, you may be able to do this for free or have the costs reduced. However, this would have to be completed through an EX160A form which you can find on the government page.

More generally, however, you will need an exceptional reason to set aside a CCJ.

How we can help
On occasion these forms can be confusing and we strongly suggest that rather than try and “muddle through” your best course of action would be to try and get them correct. Rather than commission ourselves initially we would simply suggest that you ask court staff, their advice is usually excellent, and free. Should you have difficulty, or feel you need additional support then we would be delighted to assist, simply click on the “Create a case” link at the top of this page.
